Welcome to KentServe. These Terms of Service (“Terms”) govern your access to and use of our website, as well as the strategic advisory, mail house consulting, process automation, and compliance services we provide. By accessing our site or engaging our services, you agree to be bound by these Terms.

1. Consulting Services

KentServe provides specialized B2B consulting services, including but not limited to, mail house management, high-speed print optimization, omnichannel marketing integration, AI and business process automation, and CM3 compliance assistance. The specific scope, deliverables, timelines, and fees for any consulting engagement will be outlined in a separate, mutually agreed-upon Statement of Work (SOW) or Consulting Agreement.

2. Client Responsibilities

To ensure the effective delivery of our consulting services, you agree to:

  • Provide accurate, complete, and timely information and data required for project assessments.
  • Ensure that you have the legal right to share any proprietary business data, operational frameworks, or third-party contacts with KentServe.
  • Cooperate with our team and facilitate necessary access to your systems, staff, or documentation as defined in your specific project scope.

3. Confidentiality

Both KentServe and the Client agree to hold in strict confidence any proprietary or confidential information disclosed during the course of the consulting relationship. Confidential information does not include information that is publicly known, already known by the receiving party, or lawfully obtained from a third party without breach of any confidentiality obligation.

4. Intellectual Property

Unless otherwise stipulated in a signed SOW, KentServe retains all intellectual property rights to the methodologies, proprietary AI frameworks, analytical tools, and generic templates used or created during the provision of our services. The Client retains all rights to their pre-existing data and any custom deliverables created exclusively for the Client as expressly stated in the consulting agreement.

5. Disclaimer of Warranties and Results

While KentServe leverages decades of industry expertise to provide strategic advice and operational frameworks, business outcomes depend on numerous factors outside our control (including market conditions and client implementation). Therefore, our services are provided on an “as-is” basis. We do not guarantee specific financial results, revenue increases, or guaranteed tender wins resulting from our advisory services.

6. Limitation of Liability

To the maximum extent permitted by applicable law, KentServe and its principal, Raymond Kent, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill, arising out of or in connection with your use of our website or consulting services. Our total aggregate liability for any claims arising under these terms shall be limited to the total fees paid by you to KentServe in the three (3) months preceding the claim.

7. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of South Australia, Australia, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in South Australia.

8. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the “Effective Date.” Your continued use of the website or our services after any such modifications constitutes your acceptance of the new Terms.
